Warning on the respect of intellectual property rights

The company BRICOLEURRE SARL, responsible for this site, offers products for sale by mail order that can be used to manufacture counterfeit articles. Counterfeiting is the act of reproducing or imitating something without having the right to do so. Counterfeiting can engage:

1. the civil liability of its author under Article 1382 of the French Civil Code, which may lead him to pay damages, calculated on the basis of the damage suffered by the victim;
2. criminal liability, with penalties of up to 3 years' imprisonment and a fine of 300,000 euros. In addition, once the violations have been committed in an organized group, the penalties are increased to five years' imprisonment and a fine of 500,000 euros.

The perpetrator of the counterfeiting does not need to be aware of the seriousness of his action to be held liable. Any similarity between the patented object and the allegedly infringing object, which may create confusion in the mind of a buyer of average attention, opens a presumption of infringement.

We remind you that products protected by intellectual property rights are governed by the INTELLECTUAL PROPERTY CODE. As a result, we warn do-it-yourselfers of the risks of counterfeiting lawsuits faced by people who copy proprietary products for commercialization.

In addition to this warning, we ask them to undertake to respect intellectual property rights in the context of their activities within the Atelier du bricoleurre.
